The editorial board of RSpectr has obtained a copy of the draft law on amendments to Article 46 of the Federal Law "On Communications", which proposes to supplement Part 10 of Article 46 with a new, clearly formulated ban on telecom operators allowing fraudulent traffic into their network. The authenticity of the draft law was confirmed by one of the developers of the document, Senator Artem Sheikin, member of the Federation Council Committee on Constitutional Legislation and State Building. He explained that clear wording in the document is currently being worked out to eliminate ambiguous interpretation.
The reason for the appearance of the next amendments to the Law "On Communications" was the increase in the number of offenses using information and telecommunications technologies - their share of the total number of crimes has reached 25% and continues to grow, the senator explained. In Moscow, the Moscow Region, the Krasnodar content writing service Territory and other megacities, it reaches 40%, he noted. Let us recall that from January 1, 2023, the norm on mandatory connection to the system for ensuring compliance by communications operators with requirements for the provision of communications services and services for the passage of traffic in the network and liability for violations of the connection procedure and failure to submit information to this system comes into force (Article 46.1 of the Federal Law "On Communications" and Part 3 of Article 13.2.1 of the Code of Administrative Offenses of the Russian Federation).
If the latest amendments pass parliament, telecom companies will face new challenges. At the request of government bodies or consumer complaints, operators will be required to provide information to the Ministry of Digital Development, Communications and Mass Media in accordance with the established procedure using the Unified Portal of State and Municipal Services, as well as information necessary to identify the entire chain of telecom operators involved in establishing the connection.

"Today, it is the establishment of such a chain and finding the offending operator that takes up a significant portion of the time of law enforcement agencies in the context of investigating remote theft cases. Up to seven operators are involved in the connection, to whom law enforcement agencies consistently contact and wait for a response for up to 30 days," explained Artem Sheikin.
The list of data provided by telecom companies is limited to information about the subscriber number that accompanied the call, the fact of missed telephone traffic or the fact of providing a communication service to the subscriber with the date and time. As well as information about the communication operator that participated in establishing the telephone connection. After which the Ministry of Digital Development will send the information to the authorized body to draw up a protocol on an administrative offense (Article 13.2.1 of the Code of Administrative Offenses of the Russian Federation).
If the number substitution is confirmed, the operator may be fined 200-800 thousand rubles as an individual entrepreneur or up to 1 million rubles as a legal entity. Together with the law enforcement block of agencies, additional changes to the legislation are currently being developed - the introduction of criminal liability, the senator explained.
The current bill provides for an expansion of the list of cases in which telecom operators are obliged to stop passing traffic to their network. If the amendments are adopted, if an attacker uses number substitution, including a "city" number, and makes a call with a numbering that does not correspond to the approved numbering resource assigned to the subject of the Russian Federation, such a call must be terminated by the telecom operator.
